Action in the Kittson County District Court brought by said county to recover damages for alleged negligence and breach of contracts whereby defendant Wells, Denbrook & Associates, Inc., had agreed to design a building and defendant Dean L. Witcher Incorporated, now Witcher Construction Company, had agreed to construct it. Defendant Nordenstrom Plastering Company, Inc., was the subcontractor for the exterior finish on the building, and it filed a third-party complaint against Cement Enamel Development, Inc., which had furnished the material used. The court, Warren A. Saetre, Judge, granted defendants' motions for summary judgment dismissing the action, and plaintiff appealed from the judgment entered. AUTHOR: KELLY
